Welcome to Deshame Me! These Terms of Service (“Terms”) are an agreement between you and Good Exchange, PBC, (“Good Exchange,” “we,” “our,” or “us”). They govern your use of the Deshame Me application and related services (collectively, the “Services”).
Please read these Terms carefully, as they include important information about your legal rights. By accessing or using the Services, you agree to these Terms. If you don’t understand or agree to these Terms, please don’t use the Services.
1. Acceptance of Terms
By accessing or using our Services, you confirm that:
You are at least 18 years old
You are capable of forming a binding contract with Good Exchange in your jurisdiction
You will comply with these Terms and all applicable laws and regulations
2. License and Ownership
Your Content
You retain ownership rights to the content of your conversations with Deshame Me
You grant us a worldwide, non-exclusive, royalty-free license to store, process, and display your content solely for the purpose of providing and improving the Services
We will not use your conversations to train our AI models or share them with third parties for advertising or other commercial purposes
Our Services
The Services, including all intellectual property rights in Deshame Me, are owned by Good Exchange
We grant you a limited, non-exclusive, non-transferable license to use the Services for personal, non-commercial purposes
You may not copy, modify, distribute, sell, or lease any part of our Services
3. Payment Terms
Subscriptions
Subscription fees are charged at the beginning of each billing period
Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period
You may cancel your subscription at any time
Subscription cancellation takes effect at the end of the current billing period
No refunds for partial subscription periods unless required by law
We may modify subscription fees or benefits with 30 days notice
Purchases and Refunds
All purchases are final and non-refundable unless required by law
Prices are subject to change without notice
You are responsible for all charges incurred under your account
4. Prohibited Uses
You agree not to:
Use the Services for any illegal purpose
Attempt to gain unauthorized access to the Services
Upload malicious code or content
Harass, abuse, or harm others
Impersonate others
Interfere with the operation of the Services
Attempt to reverse engineer the Services
Use the Services to develop competing products
5. Service Modifications and Termination
We reserve the right to:
Modify or discontinue any part of the Services with 14 days notice
Make immediate changes without notice for security or legal reasons
Terminate or suspend your account at our discretion if we believe you have violated these Terms
Terminate your account for any other reason with reasonable notice
If you believe your account was terminated in error, you may appeal by contacting hi@deshame.me.
6. Disclaimers and Limitations of Liability
The services are provided “as is” without any warranties. To the maximum extent permitted by law, Good Exchange disclaims all warranties, express or implied.
AI Service Disclaimers
You expressly acknowledge and agree that:
Deshame Me is an AI-powered service that may generate incorrect, incomplete, or inappropriate responses.
You will not rely on Deshame Me’s responses for any critical decisions.
We do not guarantee the accuracy, completeness, or usefulness of any AI-generated content.
You use any information or content provided by the AI at your own risk.
The AI may occasionally generate unexpected, inaccurate, offensive, or inappropriate content, and we are not liable for such content.
Conversations with the AI do not create any form of privileged or confidential relationship.
We make no representations about the AI’s ability to understand or respond to emergencies or crises.
Medical and Professional Advice Disclaimer
You expressly acknowledge and agree that:
Deshame Me is not a licensed medical professional, therapist, counselor, or healthcare provider.
The services do not provide medical advice, diagnosis, or treatment.
The services do not provide mental health counseling, therapy, or psychological services.
The services are not a substitute for professional medical care or mental health treatment.
We do not attempt to diagnose, treat, cure, or prevent any disease, disorder, or medical condition.
No doctor-patient relationship, therapist-client relationship, or any other professional healthcare relationship is created.
The AI is not trained or qualified to handle medical emergencies or mental health crises.
The services are not intended to, and do not, provide financial advice, medical advice, mental health counseling, therapy, or attempt to diagnose, treat, or cure any medical, psychological, or psychiatric conditions. Any information provided through the services is for general informational and entertainment purposes only and should not be relied upon for making financial decisions, medical decisions, or as a substitute for professional advice.
Emergency Notice:
If you are experiencing thoughts of self-harm or suicide, do not use this service. Instead, please immediately:

Call your local emergency services (911 in the US).
Go to the nearest emergency room.
For international users, contact your local crisis hotline or emergency services.
Always seek the advice of your physician, mental health professional, therapist, financial advisor, or other qualified professional with any questions you may have. Never disregard professional medical advice or delay in seeking it because of something you have read or received through the services.
Limitation of Liability
In no event shall Good Exchange be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the services, including but not limited to:
Errors or inaccuracies in AI-generated content.
Decisions made based on the services.
Loss of data or profits.
Security breaches.
Service interruptions.
Viruses or other technical issues.
Good Exchange’s total liability for any claims relating to the services shall not exceed the amount you paid for the services in the past six months, or $100, whichever is greater.
Indemnification
You agree to indemnify, defend, and hold harmless Good Exchange and its officers, directors, employees, agents, and affiliates from and against any claims, disputes, demands, liabilities, damages, losses, and costs and expenses, including, without limitation, reasonable legal and accounting fees arising out of or in any way connected with your access to or use of the services or your violation of these terms.
Force Majeure
Good Exchange shall not be liable for any delay or failure to perform resulting from causes outside its reasonable control, including, but not limited to, acts of God, war, terrorism, pandemic, natural disasters, power failures, or internet disturbances.
7. Dispute Resolution and Arbitration
You agree that any dispute with Good Exchange will be resolved exclusively through final and binding arbitration, rather than in court, except that you may assert claims in small claims court if your claims qualify.
The arbitration will be conducted by JAMS under its rules in San Francisco, California. The arbitrator’s award shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
You may opt out of this arbitration agreement within 30 days of first accepting these Terms by emailing hi@deshame.me.
8. Information We Collect

Data used to track you: We do not track users across apps and websites owned by other companies

Name (through messenger apps or Substack)
Email address (through Substack)
User ID (to maintain your account)
Usage data (to improve our services)
Diagnostics (crash data and performance information)
Information You Provide to Us
When you use our Services, we collect:
Account information:
Name
User ID of the messenger platform
Chat logs and message content from your interactions with Deshame Me
Any feedback, support requests, or communications you send to us
Information We Collect Automatically
When you use our Services, we automatically collect:
Usage information (such as how you interact with the Services, the features you use, and the time spent using the Services)
Technical information about your connection to our Services
Information Related to Age Restrictions
Our Services are intended for adult users only, as content may contain infrequent or mild references to fear, crude humor, drug use, suggestive themes, or treatment information. We do not knowingly collect information from users under the age of 18.
9. How We Use Your Information
We use the information we collect to:
Provide, maintain, and improve our Services
Process your account registration
Enable your communications with Deshame Me
Monitor and analyze trends, usage, and activities in connection with our Services
Detect, investigate, and prevent security incidents or other fraudulent, harmful, or illegal activity
Debug to identify and repair errors in our Services
Comply with legal obligations
Respond to your requests, comments, or questions
Send you technical notices, security alerts, and support messages
AI and Chat Data Usage
Regarding our AI technology and chat data:
We do not use any identifiable user data to train our AI models
Your chat data is stored securely and is only accessible to you, to us, and to our LLM API providers
Chat history is retained as long as your account remains active
You can request deletion of your chat history at any time
10. How We Share Your Information
We share your information in the following circumstances:
With service providers and business partners who assist in providing our Services, including:
Hetzner for secure data storage and hosting
LLM API providers (currently Google, potentially OpenAI or Anthropic in the future) for processing
Messenger apps for our communication with you
Substack and Peddle for subscriptions
When required by law or to respond to legal process
To protect our rights, privacy, safety, or property
In connection with a business transfer, such as a merger, acquisition, or sale of assets
We do not sell your personal information or share it with advertisers.
11. Data Retention
We retain your information indefinitely while your account is active. If you close your account, all of your messages and conversation history will be permanently deleted. Please note that we may retain certain non-identifiable information as required by law or for legitimate business purposes.
12. Your Rights and Choices
You have the right to:
Access the personal information we hold about you
Request deletion of your personal information
Opt out of certain data collection
Close your account at any time
Request a copy of your data

13. Security
We implement appropriate technical and organizational measures to protect your information. Our security measures include:
All communications between you and our services are encrypted with TLS
Intensive employee restrictions and monitoring on access to user data
Regular security updates
However, no security system is impenetrable, and we cannot guarantee the security of our systems 100%.
14. Children’s Privacy
Our Services are not directed to children under 18. We do not knowingly collect personal information from children under 18. If we learn that we have collected personal information from a child under 18, we will take steps to delete such information.
15. Changes to This Policy
We may update this Privacy Policy from time to time. We will notify you of any material changes by posting the updated Privacy Policy in our app and updating the “Last Updated” date.
16. International Users
Our Services are hosted in the United States. If you access our Services from any other region with laws governing personal data collection, processing, or retention that differ from United States laws, please be advised that through your use of our Services, you are transferring your personal information to the United States and you consent to that transfer.
17. California Privacy Rights
California residents may have additional rights regarding their personal information under the California Consumer Privacy Act (CCPA). For more information about your California privacy rights, please contact us using the information above.
18. Geographic Restrictions
The Services are operated from the United States. If you access them from other locations, you do so at your own risk and are responsible for compliance with local laws.
You may not use the Services if you are located in any U.S. embargoed countries or are on any U.S. government restricted parties lists.
All data is stored on servers located in the United States.
19. Changes to Terms
We may modify these Terms at any time by posting updated Terms on our website. Your continued use of the Services after any changes indicates your acceptance of the modified Terms.
For material changes, we will provide notice through the Services at least 14 days in advance, unless we need to make immediate changes for security or legal reasons.

21. Severability
If any provision of these Terms is found to be unenforceable, that provision will be severed from these Terms and will not affect the validity and enforceability of any remaining provisions.
